Supreme Court allows prosecution of medical marijuana users.
  • Contrary to the common misunderstanding floating around the internet, this was the work of the liberal members of the court. The liberals voted 4-0 in favor of the ruling. The conservatives voted 3-2 against. The very conservative Justice Thomas wrote in his DISSENT exactly what the conservatives and libertarians(including me) believe:
    "Respondents Diane Monson and Angel Raich use marijuana that has never been bought or sold, that has never crossed state lines, and that has had no demonstrable effect on the national market for marijuana. If Congress can regulate this under the Commerce Clause, then it can regulate virtually anything—and the Federal Government is no longer one of limited and enumerated powers."
  • What should happen is this: Congress should pass a law exempting the medical use of marijuana from Federal control. Then the states would be free to allow it or not allow it. That would make medical marijuana just like medical use morphine which (to my admittedly limited knowledge) causes no problems of any significance.

  • I have a barometer for reviewing the Supreme Court's decisions. While eight members are essentially partisans who look for tenuous legal justifications to support their pre-conceived notions, Judge Souter's decisions can always be counted on to be his best possible impartial analysis of the applicable law. (Hey, an honest man can sneak into government once in a while. It isn't likely, but it can happen.) At any rate, Souter did not write a separate opinion on this case, but he did side with the majority, which leads me to believe that it is the correct legal opinion, irrespective of how I feel about it. As the court pointed out, Congress can resolve the controversy (if it chooses) by passing a bill allowing the medical use of marijuana.
